Product Warranty

This warranty is provided by Sleeper Hut Pty Ltd

Warranty

We warrant that the product is:-

  • fit for all intended purposes the product is commonly used for; and
  • compliant with the relevant Building Code, Regulations and Australian Standards and guaranteed to perform under normal domestic and commercial loads.

(express warranty)

for a period of 10 years from the date of original purchase.

If this warranty is breached we will, at our expense and at our election (in our sole discretion) do one of the following:-

  • resupply the product (or an alternate equivalent product) that does not meet the warranty; or
  • repair the product; or
  • compensate you for the reasonable cost to repair the product.

Limitations

The warranty applies only to:

  • defects occurring in materials and/or workmanship where the product is used for its intended purpose; and
  • where the product has been installed in compliance with all relevant Building Codes, engineering requirements,

Regulations and Australian Standards.

This warranty does not apply to the following:-

  • Where the product is not being used for its intended purpose;
  • Ground movements effecting the product;
  • Excavation, digging or soil removal within a reasonable range of the product;
  • Damage sustained by heavy machinery use;
  • Damage sustained by overloading;
  • Fair wear and tear and normal weathering;
  • Damage sustained during handling and storage;
  • Reused products;
  • Damage arising out of extreme conditions including ingress of higher than normal levels of salts, water, sandstorms, marine or industrial influence;
  • Failure to install in accordance with all relevant Building Codes, Regulations and Australian Standards;
  • Failure to maintain resulting in the issue;
  • There is abuse, misuse or neglect by you;
  • Where there is a change to the aesthetic of the product wholly or partly due to water ingress to and/or egress of salt;
  • Where the product has been altered, modified or damaged by you (for example, cutting the product) or any ‘force majeure’ event including but not limited to earthquake, flood, act of God, war or any other event outside our control;
  • Failure to submit the claim in accordance with the claims procedure and within the time limitation under the warranty.

To the extent permitted by law and subject to any liability under the Australian Consumer Law which cannot be excluded, we will not be liable for any incidental or consequential losses, damage, injuries or otherwise however suffered or incurred or failure due to accidental damage, impact, misuse or negligence of any third party.

To the extent permitted by law, the warranty expressions specified exclude any other implied or oral undertakings and we are not liable in contract, tort or otherwise to compensate you for any increased costs or expenses, loss of profit, business, anticipated savings, additional expenses resulting from a third party claim or any special, indirect or consequential loss or damage of any kind whatsoever caused by our failure to comply with our obligations.

In no circumstance, shall the liability be greater than the amount paid for the product.:

Additional costs such as insurance, freight, our travel and transport costs, reinstallation and disposal will be at your expense and you will not be entitled to a refund of these additional costs.

Coverage

The benefit of this warranty cannot be transferred or assigned without our consent.

If necessary, you will permit us or a nominated third party to inspect the product and complete all necessary investigations and tests to assess the nature of the issues with the product. You are to provide reasonable access to the property where the product is situated.

This warranty only applies where the product is used in Australia.

Australian Consumer Law

Goods of a type not ordinarily acquired for personal, domestic or household use or consumption

The following statement applies if the supply of the product to you is a supply to a consumer as defined in the Australian Consumer Law and the goods are of a type not ordinarily acquired for personal, domestic or household use or consumption.

To the extent permitted by law, if the express warranty has been breached and the goods are of a type ordinarily acquired for personal, domestic or household use or consumption then our liability under the express warranty is limited to, at our election, doing one of the following:-

  • resupply the product (or an alternate equivalent product) that does not meet the warranty; or
  • repair the product; or
  • compensate you for the reasonable cost to repair the

The following statement applies if the supply of the product to you is a supply to a consumer as defined in the Australian Consumer Law and the goods are of a kind ordinarily acquired for personal, domestic or household use or consumption.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

The express warranty provided to you is in addition to the guarantees provided under the Australian Consumer Law, are subject to the conditions and exclusions contained in our express warranty and are in addition to any compulsory statutory warranties which may also apply to the product.

Claims Procedure

In order to make a claim under this Warranty please submit your claim in writing to:

All claims must be submitted within fourteen (14) days of the claimant becoming aware or reasonably aware of the issues with the product and include the following:-

  • Your contact details (phone, email, address);
  • Property Address where product is situated;
  • Reasonable evidence of the date of your original purchase (for example, a sales receipt);
  • Details of the issues with the product;
  • Photographs identifying the issues (if available).
